Post Office, Fife, Scotland  Complaint
22nd January 2021
Dear Sir/Madam
Re :Claim for Reasonable Adjustments Disability Discrimination
I am writing this letter because I am disabled and cannot wear a face covering.
I have surgical procedure of Gatoplasty , Acid reflux, also skin condition Rosacea. I am therefore disabled within the meaning of s.6 of the Equality Act 2010 (“the Act”).
What has Happened.
I attempted to do a post office transaction for banking in your shop on 20/1/21 at approx. 10.50am On entry to the shop you mistook my identity and greeted me as " Hi Lesley" then realised you had the wrong person. I asked for a balance of my card account. You then confronted me with "do you not have a mask" I stated you were not allowed to ask me this and proceeded to display the attached law to you from the Government website about the law on mask and section 112 of 2010 Equality act. You would not read it you then proceeded to tell me to get out your shop. 2 members of the public were in the queue outside and you then moved yourself from behind the counter and went outside the shop and proceeded to impart to 3 members of the public a barrage of untruth that you did not challenge me about wearing a mask. Arguably at this time you were imparting my health conditions to other members of the public without my consent. Furthermore, you told me to get out the shop once more that this was your business. I left and on leaving I stated that i would be raising legal action against you for what you had just subjected me to. None of the public commented. Due to the severity of this complaint, I should integrate the post office head office, as i question how fit you are to be conducting post office business ( Finsbury Dials 20 Finsbury Street, London, EC2Y 9AQ )Find attached supporting captures of the incident and legal documentation that was provided to you in this plight, that you refused to engage with As a consequence, I have not been able to access your services. My Legal Rights In providing advice, information and products to the public, you are providing a service within the meaning of Section 29 of the Equality Act 2010 (“the Act”). my inability to wear a face covering. I am therefore subjected to discrimination within the meaning of sections 13 of the Act and section 15 in not providing me with a service contrary to section 29(1) of the Act. By not serving customers unless they wear a face covering, disabled people with aforementioned conditions like me,  are at a substantial disadvantage in using your service in comparison with persons who are not disabled who are able to wear face coverings.
As the Equality Act 2010 Statutory Code of Practice on services, public functions and associations states at para. 7.21:-Your failure to comply with your obligations under sections 15, 19 and 20 has resulted in me experiencing a detriment, contrary to section 29. This list is not exhaustive.
In addition, by subjecting  me to the treatment set out above, questioning me as to my disability, singling me out in front of the public and refusing to accept my explanation, and/or the Manager and Security then being dismissive of my complaint, and escorting me off the premises you have subjected me to harassment within the meaning of section 26 of the Act – unwanted conduct related to my disability, which has had the effect of violating my dignity and creating a hostile degrading humiliating and/or offensive environment for me. Legislation and Government Guidelines
I also draw your attention to The Government November 2020: https://www.gov.uk/government/publications/face-coverings-when-to-wear-one-and-how-to-make-your-own/face-coverings-when-to-wear-one-
Further, carrying an exemption card, or proof of disability is not required in order to benefit from this exemption. Clearly, I fall within the above guidelines because [putting on and wearing a face covering causes me] severe distress .Disclosure Please provide me with: CCTV footage from your shop, covering the incident in question; Your policy relating to Face Coverings; Any internal documents relating to the above incident What I would like you to do I would like you to give me an undertaking that you will change your policy of refusing service to customers who cannot wear face coverings. I would also like you to retrain your staff as to the Government Guidelines and to provide disability awareness training. I require a written apology for the way i was treated i require Financial compensation of £200 Two hundred pounds sterling for the distress, humiliation, and injury to my feelings in this incident I look forward to hearing back from you by return of 14 days from the date of this letter . If I do not hear from you within that time frame, I will instruct Fry Law to commence legal proceedings, which will include a claim for compensation and legal costs. I very much hope matters can be resolved amicably.
Yours sincerely
